The Supreme Court struck down IEEPA tariffs. If your company imported goods from China, Canada, or Mexico — you may be owed a significant refund plus 6% annual interest. We help you navigate the process.
On February 20, 2026, the U.S. Supreme Court ruled that tariffs imposed under the International Emergency Economic Powers Act (IEEPA) were unconstitutional. This landmark decision affects tariffs on imports from China (up to 145%), Canada (25%), and Mexico (25%).
The Court of International Trade subsequently ordered U.S. Customs and Border Protection (CBP) to begin processing refunds immediately. CBP is building the CAPE system — a new electronic platform specifically designed to handle the massive volume of refund claims.
The window to act is now. Interest accrues daily, and companies that prepare their documentation early will be positioned to receive refunds faster once the system is fully operational.
IEEPA tariffs were imposed on goods from China (up to 145%), Canada (25%), Mexico (25%), Vietnam, India, Bangladesh, the EU, South Korea, Taiwan, and dozens of other trading partners. If your company imported goods from any of these countries between February 2025 and February 2026 and you were the importer of record, you likely qualify.
Your company was the importer of record on entries that were assessed IEEPA tariffs. You directly paid the duties to CBP.
You paid tariffs under IEEPA authority on goods from China (up to 145%), Canada (25%), or Mexico (25%). These are distinct from Section 301 or other trade remedy duties.
You have access to entry summaries (CBP Form 7501), commercial invoices, and bills of lading for the affected shipments. Your customs broker may also have these records.
Not sure if you qualify?
Many companies are unsure whether their imports were subject to IEEPA tariffs specifically. We can help you review your entry data and determine your eligibility at no cost. Fill out the form below to get started.
U.S. Customs and Border Protection is building the Consolidated Administration and Processing of Entries (CAPE) system to handle IEEPA refunds. Here is how it works.
Importers and brokers submit refund requests through a web-based interface. You upload summaries of entries for which you are requesting IEEPA refunds in a standard format.
The system removes IEEPA tariff codes and recalculates duties as if those tariffs were never applied. This automated step handles the bulk of the computational work.
CBP reviews entries identified in the accepted CAPE Declaration. It updates entry summaries, calculates interest, schedules liquidations, and flags entries requiring manual review.
Refunds are consolidated and processed electronically to designated ACH accounts. Companies must be enrolled in CBP's ACH Refund program to receive payments.
